All visitors, users, and others accessing or using this website are subject to these Terms. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of the Terms, you are not permitted to use the Service.

INTELLECTUAL PROPERTY & LICENSING

We periodically revise our Terms. Please ensure you understand and agree to our Terms before using our images. If you have questions or concerns about image licensing and usage, contact us before using the images.

By paying the invoice and/or using our images, you accept all the terms and conditions of this license in entirety.

The following terms apply:

1. License: We (ESTATE PHOTOS LA) grant the Licensee (the invoiced client and any co-listing agents) a non-transferable license to use our images. Images cannot be sold, distributed, or used by anyone else, such as developers, owners, contractors, architects, designers, stagers, etc., without our separate licensing. All image requests should be referred to us. The Licensee can reproduce and use our images for marketing the photographed property during the listing agreement. The Licensee can also use the image for their personal promotion related to prior real estate sales.

2. Image Ownership: We retain all copyright to our images, as per U.S. Copyright law.

3. Licensee's Responsibility: The Licensee must have legal authority or consent from property owners to photograph the property and allow us to use or sell the images for our commercial and promotional purposes.

4. Use by Publications: Any images used by publications promoting the property sale must credit us. The Licensee cannot distribute images to publications for general use or after the property sale or the Licensee’s listing agreement expiration.

5. Image Alterations: Any image alterations require the invoiced agent's prior consent, who assumes liability for the image use.

6. Property Websites: We own property websites and their registered domains. We provide them for the listing duration, up to one year, and we must host them. Hosting beyond one year may incur additional fees.

7. Legal Rights: This agreement doesn't exclude additional legal rights for copyright holders or curtail licensee's statutory rights.

PAYMENT TERMS, LATE PAYMENT PENALTY, AND CANCELLATION POLICY

LATE INVOICE PAYMENT AND LEGAL ACTION

1) Invoices are due immediately upon receipt. It is vital to our business operation that all invoices are paid promptly. Therefore, we enforce a strict late payment policy.

Should an invoice not be paid within 15 days of being received, a penalty will be applied. This penalty consists of an initial late fee of $50, plus an additional interest charge of 5% per month on the outstanding amount, accruing from the day following the due date.

We reserve the right to withhold services, including the delivery of any future images until any outstanding invoices and associated penalties are fully paid. Continued late payment may result in the termination of our services.

Please note that in cases of persistent non-payment, we also reserve the right to take legal action to recover the debt.

We urge all clients to adhere to these payment terms to avoid any unnecessary delays, additional costs, or potential legal action.

This clause ensures prompt payments and helps us maintain our high-quality service for all our clients.

2. Cancellations/Rescheduling: If you need to cancel the shoot, please notify us at least 48 hours in advance. Cancellations made without providing 24 hours notice will result in a 50% cancellation fee. Please note, if our photographer arrives at the scheduled location and discovers that the shoot has been canceled without prior notice, or if the property is not ready for the shoot without prior notice, the full amount for the shoot will be charged.

Our Service may contain links to third-party websites or services, over which we have no control or responsibility. We advise you to read the terms, conditions, and privacy policies of any third-party websites or services you visit.

TERMINATION

We may terminate or suspend access to our Service without prior notice or liability, for any reason, including a breach of these Terms. Provisions that by their nature should survive termination will do so.

GOVERNING LAW

These Terms will be governed by the laws of the United States, without regard to conflict of law provisions.

CHANGES TO TERMS

We reserve the right to modify or replace these Terms at our sole discretion. For material revisions, we aim to provide at least 30 days notice. By continuing to access or use our Service after revisions become
